Terms & Conditions

​All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable laws. If you do not agree to these terms and conditions, please do not use this site.

​WEBSITE CONTENT:

 

We do our best to provide detailed and accurate product information that includes descriptions, photographs and MP3 or video demonstrations (when applicable) to help with your purchase. All product images are represented as accurately as possible. All MP3 product files are recorded with a single microphone and are raw audio files, ie. they have not be manipulated at all. Every effort is taken to ensure an accurate audio representation of the instruments, however what a microphone records and what is heard when playing the instrument will vary.

 

CURRENCY:

All prices are listed on this site are United States dollars (USD) unless otherwise stated.

PRODUCT PAYMENTS AND TERMS:

All payments are to be made with Paypal, unless prior arrangements have been made. Items online for sale can be purchased through our store. To commission an n'goni, you can place your order by sending us an email. We will reply with an estimate of how much time is required to complete what you want. If you agree to that, we require a $200 non-refundable deposit before the piece is started.

 

Once we have received this deposit we will begin making your n'goni. We will not begin work until we have received the deposit. Usually your n'goni will be started within two days of receiving the deposit and once we have begun to make your n'goni, we cannot refund the deposit as it is used for the cost of the parts required to get us started. The balance (including freight) is payable once your n'goni is finished. The deposit confirms the price of the n'goni and should the price on our website increase, you will still pay the same price as agreed when you made your deposit.

 

Your n'goni can take anywhere between two weeks and several months to be made, dependent on our workload when you place your order. Because we focus on top quality instruments, we do not rush our work. This means that sometimes we have several orders at once and a short waiting list. We process all of our orders as a first come first served basis. We do our very best to get your n'goni made to your specifications and within your ideal time frame.​

 

INSTRUMENT CUSTOMISATION:

All Resonance n'goni are custom made to your requirements (acoustic preference, aesthetic desires, hand size, etc).

 

The acoustic customisation is managed through use of specific terms such as bright, bass rich, warm, light, crisp, etc. and whenever possible references to those sounds in video or audio form are used. We do our best to match your acoustic desires exactly so you are very happy with the sound of your n'goni.

 

The aesthetic customisation varies depending on what model n'goni you choose and is described in the instrument info details. You can have the option of choosing from materials that we currently have in stock or that we have immediate access to. This means in some cases you can choose the type of wood you would like (subject to availability) and the overall look of the instrument by referring us to pictures of existing instruments in the gallery of www.ngoni.org.  You will receive emails regarding these options. The aesthetic customisation of our instruments does not include styles or designs of your own creation.

 

The ergonomic customisation makes the instrument perfect for you. Typically we follow a span ratio that we have developed that works for the vast majority of people, however in some cases people have very big (or small) hands and require a different span between strings. You will receive emails regarding this and your needs.

GUARANTEE & RETURN POLICY:

 

All of the products here are top quality. If for some reason there is a defect in workmanship of the stem, machine heads or bridge, www.ngoni.org offers a full credit, repair or replacement guarantee for the cost of these goods. This is valid for ten years from the date of purchase. This includes freight charges, but not importation charges, which are the responsibility of the purchaser. The term defect is used here to describe the functionality of the product and is not inclusive of aesthetic irregularities, which are often a feature of the products listed here.

 

In the unlikely event that you should you find a defect with your purchase, you have 7 days from receiving your item to notify www.ngoni.org. If the goods are deemed to be defective by us, you will be issued with a credit and/or the goods will be returned and/or repaired/replaced. This will be at the discretion of www.ngoni.org. Freight costs for the original sending of the package remain the responsibility of the purchaser. The purchaser agrees to pay for the freight of any returned goods under this guarantee. The purchaser agrees to contact www.ngoni.org before returning goods under this guarantee to receive a return authorization. This guarantee does not cover damage due to neglect, misuse, abuse or accident.

 

NB: Any alterations or additions to your Resonance n'goni by a non-Resonance luthier or any third party will term your guarantee null and void. This can, but is not limited to, things such as attaching pick ups to the skin and drilling holes in the gourd for cables. Standard disassembly and assembly of your Resonance kitset n'goni and changing strings does not effect your guarantee.

This guarantee does not cover damage due to secondary transportation (ie. airline travel, road or freight) after the instrument has been received by the customer. It does not cover damage due to assembling the instrument incorrectly or by using third party accessories or service providers. www.ngoni.org reserve the full right to assess all claims as we deem appropriate, with all due diligence and fairness.

INTERNATIONAL FREIGHT AND INSURANCE:

Most countries have an importation tax that is calculated as a percentage of the total amount of the purchase price of your item. Sometimes this also includes the freight cost of your item. This tax is payable by the receiver of the goods. Importation taxes vary between countries so check if you are unsure. www.ngoni.org does not accept responsibility for payment of any customs duties, charges or taxes should it be levied in the customer's country.​ Smaller items such as kesing kesing and n'goni bags can be sent to a post box. Larger products such as the n'goni need to be sent to a residential or business address as the freight company require a signature on delivery. All freight is fully insured against loss and damage. This is included in the freight costs.

INCORRECT OR INCOMPLETE ORDERS:

In the unlikely event of an incorrect order or an item missing from an order, the purchaser must notify www.ngoni.org within 7 days of delivery. It is the responsibility of www.ngoni.org to arrange the correct or missing item or items to be shipped at no extra cost to the purchaser. The cost of returning any incorrect items is the responsibility of www.ngoni.org.

DAMAGED ITEMS:

If an item is damaged upon arrival, you must notify us within 7 working days of delivery. You are required to keep all boxes and packaging for possible inspection by the freight company. Details of the damage will be taken and the claim processed between www.ngoni.org and the shipping company. It is our responsibility to replace the damaged item free of charge.

COPYRIGHT & ACCEPTABLE USE POLICY:

All information and/or data on this web site including but not limited to text, sound files, photos, videos etc. is under copyright by www.ngoni.org. You may use any information or data on this web site for your personal use. If you wish to publish any of our data, files or information anywhere, you will need to request permission to do so by sending an email to www.ngoni.org. www.ngoni.org reserves the full right to approve or refuse any request for use of any information and/or data from this website.

PRIVACY:

All email addresses sent to this site will be treated as confidential by www.ngoni.org. Under no circumstances will www.ngoni.org supply this information to marketing companies or other third parties. All users of this site understand that email feedback may or may not be listed in the testimonials section of www.ngoni.org. www.ngoni.org reserves the right to use any email feedback as testimonials on this website.

 

SITE MEMBERSHIP:

 

All approved members of www.ngoni.org will enjoy access to free tuition videos. Site membership is valid for one person, in this case being the initial owner of a Resonance n'goni. It is not valid for additional persons, including but not limited to spouses and family members, nor is it valid for persons who are the second owner (and so forth). The membership is not transferrable. If the purchase of your Resonance n'goni is a gift, the purchaser must inform www.ngoni.org of the owners details so the owner can enjoy access to the videos. Access to the tuition videos is strictly limited to owners of Resonance n'goni. By using the site membership, the user understands that their login details will be monitored. The sharing of site login details, including email addresses and passwords will not be tolerated and will result in the immediate termination of site membership. www.ngoni.org reserves the full right to approve, disapprove or remove members as it deems appropriate.

INDEMNIFICATION:

You agree to indemnify, defend, and hold harmless www.ngoni.org, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your internet account.

TYPOGRAPHICAL ERRORS AND OMISSIONS:

Considerable care has been taken with the preparation of all content on this website www.ngoni.org will not be held responsible for typographical or other errors or omissions regarding prices or any other content.
